By placing an order with us you will be deemed to have read, understood and agreed to these terms and conditions. Techmar UK is a trading name of IrriFence Limited. All references to the ‘company’, ‘us’, ‘we’ and ‘our’ within these conditions will refer to IrriFence Limited.
Any information displayed on this web site, or other printed matter by the company is not regarded as authoritative or certified as best practice, and is only to be considered as useful supplementary information or advice.
A contract between the customer and IrriFence Limited for the sale of our products will only exist once an order has been accepted, processed, despatched, and full payment has been taken by way of charging the buyer’s credit/debit card. This does not affect the customer’s statutory rights.
All prices are in pounds sterling (inclusive of UK VAT at the current rate unless clearly stated otherwise), but are subject to change without prior notice.
All prices and specifications are checked to the best of our ability, and whilst every effort is made to maintain their accuracy, no responsibility will be accepted for errors or omissions. We reserve the right to alter our specifications without notice.
Delivery is a standard £12.50 plus vat within mainland UK, by courier. Delivery is free on orders over £200 (excluding VAT). Normal leadtime is 5 – 7 working days.
If the items you require are out of stock then we will order for you. Items take approx. 2 – 3 weeks to supply. Cancellation of orders can be made prior to dispatch without incurring any penalty. Please note: While IrriFence Limited takes all reasonable steps to ensure a fast and reliable service, it cannot be held responsible for late or non-delivery by postal services or appointed carriers. All delivery charges are subject to change without prior notice.
We accept online payment in a secure third party environment by credit/debit card (not AMEX). Using this method no customer card details are seen, handled, recorded or retained by IrriFence Limited, its officers or its employees. We feel this gives better peace of mind for our on-line customers. We can also accept payment by BACS or cheque payment – Goods dispatched upon clearing of payment (5 working days)
We have a no-quibble returns policy, where customers have a total of 7 days to evaluate and return their purchase, as long as it has not been damaged, used or modified in any way. Fittings returned after more than 7 days incur a 25% re-stocking charge. The item(s) should be returned in their original packaging with all fittings and instructions(i.e in a re-saleable condition).
You may return the item(s) for a refund or an exchange at your discretion. We can however only refund to the same credit/debit card used for the original purchase; if this has expired, then refunds will be made by way of bank transfer or cheque in GB Pounds only.
Where the product you received was either faulty or not as ordered then we will refund your reasonable return postal costs at our discretion. Faults or damage occurring from lack of care or mishandling will be chargeable at the full rate. We recommend that all returns are sent by registered (or ‘signed for’) post, as we cannot take responsibility for items that do not reach us.
You have the right, under distance selling regulations, to cancel your order for any reason within seven working days following the day after delivery for any unused item purchased through this web site, and to receive a full refund for the returned goods.
Where supply only IrriFence Limited can take no responsibility for the installation of lighting. We always recommend employing a fully qualified (Part P Certified) electrician to install any external lighting if this involves any work on mains electrical circuitry or fittings. Upon installation please ensure that flanges are screwed firm (not over tight and check that the glass lens is in place!). When periodically replacing lamps ensure that the orange “O” ring and glass lens remain free of dust and grit.
Please note that bronze and copper fittings will age over time. All powder coated fittings are UV stable. Colour range:- Arctic White, Beige, Bronze, Dark Grey, Federation Green, Olive Green, Matt Black, Primrose & Silver Star.
This website, and our Terms and Conditions have been designed for use within the United Kingdom and under UK law. Any disputes will be resolved exclusively in the courts of England & Wales in accordance with English law. We do not currently accept orders from outside the United Kingdom, and we give no warranty, express or implied, that the use of this website or the placing of any order from outside the UK, either through this website or directly with IrriFence Limited, complies with any applicable non-UK laws or regulations. Nothing in these terms and conditions will be deemed to affect your statutory rights.
We will not be liable for non-performances of our obligations caused or resulting from industrial disputes or any other circumstances beyond the reasonable control of the company such as act of God, riots, civil commotion, flood, fire and legislation. If by reason of such circumstances it shall become impossible within a reasonable time for the company to wholly or partly supply the items ordered then the customer’s liability will be limited to the value of the items already supplied together with any associated delivery charges.
Disclosure & Limitations of Liability
To the fullest extent permitted by law, IrriFence Limited shall not be liable to any user of its web site, or individuals or Corporate bodies placing an order, by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of any contract, or in negligence (whether on the part of IrriFence Limited or any of its agents, directors, employees or otherwise) for any indirect, special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of, or in connection with, the use of this website, the supply of the products or their use or resale by you.
While IrriFence Limited uses reasonable endeavours to ensure that the information on this website is accurate and up to date, it does not give any warranty as to its accuracy or completeness and IrriFence Limited, its agents and sub-contractors, will not be responsible for any errors or omissions or for the results arsing from the use of such information.
IrriFence Limited does not guarantee that your use of this website will be interruption or error free and will not be responsible for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto any computer system.
Similarly, IrriFence Limited shall not be responsible or liable for any errors or losses, however arising, from your use or interaction with 3rd Party software that may be accessed via links from this site. Any such 3rd Party software links are provided merely as a service to users of this web site or in connection with providing secure payment services for the purchase of products offered on this site.
While IrriFence Limited takes all reasonable steps to ensure a fast and reliable service, it cannot be held responsible for the late or non-delivery by postal services or appointed carriers, and cannot be held liable for any consequential losses arising for such late or non delivery.
The entire liability of IrriFence Limited under or in connection with any contract for any products to which these conditions apply shall not exceed the sterling price of the products, except as expressly provided in these conditions.
IrriFence Limited will not be liable to you or be deemed to be in breach of any contract by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the products ordered by you if the delay or failure was due to any cause beyond its reasonable control.
IrriFence Limited may assign or transfer any of its rights or sub contract any of its obligations under these terms and conditions to any third party. You may not assign or transfer any of your rights or sub contract any of your obligations under these terms and conditions except with the specific permission in writing of IrriFence Limited.
No person who is not a party to these terms and conditions shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999. Nothing in these conditions is intended nor shall affect any of your statutory rights that may not be legally excluded.
IrriFence Ltd is committed to protecting and respecting your privacy. We wish to be transparent on how we process your data and show you that we are accountable with the GDPR in relation to not only processing your data but ensuring you understand your rights as a client.
General Data Protection Regulation (GDPR)
In May 2018 the new General Data Protection Regulation (GDPR) comes into effect. It replaces the Data Protection Act 1998. It is designed to better protect the personal information directly or indirectly given to companies and organisations.
In compliance with GDPR we will collect, store, use and retain your personal data appropriately.
This means we will:
* Only collect data that helps us to offer you the best service possible – we will therefore not collect or retain excessive amounts of data. * Take appropriate steps to protect your personal data once it’s collected. The lawful basis for processing your personal data
We are required to relate our data collection and processing activity to a ‘lawful basis’ in order to comply with GDPR guidelines.
Contract: The lawful basis for collecting and processing your data is that we have a contract. From the outset you have sought our services and we have agreed to provide them and this constitutes a verbal (it may also be written) contract. Therefore having agreed what we will offer, when and how regularly we will meet and what the fee is for this service, this contract is the lawful basis on which we can store and process your personal data.
Legitimate interest: The second legal basis for collecting and processing your personal data is that having this information is necessary for us to be able to deliver our services we’ve agreed to offer you, and you would be unable to receive our service without giving us this information – so therefore it is in both the client’s and Irrifence’s ‘legitimate interests’.
* You have the right to request a copy of the personal data we have collected.
* You have the right to request that any incorrect or incomplete data be corrected or completed if it is found to be inaccurate.
* You have the right to request that the data is erased where it is no longer necessary to be stored.
